Mr. Jeff Blackard, 401 Adriatica, McKinney, Texas, stated that he concurs with Staff’s recommendations. Commission Member Staif asked if this is going to be a coffee shop or an ice cream shop. Mr. Blackard stated that the vessel will contain both an ice cream parlor and a coffee shop. Commission Member Staif stated that the maintenance agreement refers only to an ice cream parlor. Mr. Blackard stated that there will be two shops contained in the vessel. Commission Member Staif asked if the maintenance agreement also needs to indicate that there is to be a coffee shop. Mr. Blackard stated yes. Commission Member Staif stated that the maintenance agreement also referenced a restaurant. Mr. Blackard stated that there is no restaurant. Commission Member Staif asked what type of material will be used by the applicant to protect children from falling overboard. Mr. Blackard stated that the vessel will have a 42 inch railing. Commission Member Staif asked what would happen if the ice cream parlor goes out of business. Mr. Blackard stated that the maintenance agreement states that nothing can replace it. Commission Member Staif asked what if the coffee shop goes out of business. Mr. Blackard stated that there would only be a boat sitting out in the harbor. Commission Member Staif asked if people would still be able to go onto the boat. Mr. Blackard stated yes. Commission Member Tate asked if the boat is something that can be put on the lake or is it built on site. Mr. Blackard stated that the boat will be built on site. Mr. Blackard explained that the boat will be built with iron-wood known as "Eutuba Brazilian wood" and the wood will last approximately 100 years. He stated that he took the actual Galleon Dubrovnik drawings, which is a ship dating back to the 1600’s, to a Naval architect who designed the ship so that it would be safe. He stated that the ship will be built with a steel hull on the inside and covered with iron-wood. Mr. Blackard stated that for maintenance purposes, steel would last for at least 100 years and the wood would last approximately 100 years. Commission Member Staif asked if the applicant is responsible for the maintenance or would the ice cream parlor and coffee shop be responsible. Mr. Blackard stated that he is responsible for the maintenance of the ship. Commission Member Staif asked if maintenance would be performed on a daily basis; specifically with regards to litter, etc. Mr. Blackard stated that he maintains his side of the lake everyday. Commission Member Staif asked what would happen if debris went over to the other side of the lake. Mr. Blackard stated that he assumes the neighbors would inform him and he would take care of it. Commission Member Staif asked if there will be water on all sides of the boat. Mr. Blackard stated yes, and the boat will be situated so that it will not move. Commission Member Staif asked if the ice cream parlor and coffee shop will have certain hours of operation. Mr. Blackard stated yes. Commission Member Staif asked if the ice cream parlor and coffee shop close down for the day, will anyone be able to have access to the boat. Mr. Blackard stated no, it will be closed to the public. He stated that it has a plank that is ADA approved and there are bars that will deny access to the ship. Mr. Blackard stated that unlike the rest of Stonebridge, Adriatica falls under the Stonebridge HOA and will also have their own HOA. An additional HOA for only the Harbor District is built within the Adriatica HOA. Mr. Blackard stated that Adriatica has a commercial and residential homeowners association and the 4.32 acres referenced in the staff report falls within the commercial association. Mr. Quint gave the staff report, explaining the proposed specific use permit. He stated that the applicant is proposing to construct a boat within Stonebridge Lake as part of the Adriatica development. Mr. Quint stated that the proposed boat will feature approximately 800 square feet of floor area and will be utilized as an ice cream/coffee shop. He stated that the governing planned development ordinance requires approval of a specific use permit prior to construction of such a structure. Mr. Quint stated that Staff is recommending approval of the proposed specific use permit with the special ordinance provisions listed in the staff report. Commission Member Staif asked that because the maintenance agreement refers strictly to an ice cream parlor will the maintenance agreement need to be revised. Mr. Shelton stated that under the City’s use chart both a coffee shop and an ice cream parlor would fall under restaurant. He stated that the maintenance agreement specifically references an ice cream parlor but it also states that restaurants are allowed so long as they do not utilize a grease trap. Commission Member Ussery asked if the City Attorney approved the maintenance agreement document. Mr. Shelton stated yes. Commission Member Tate asked if parking for the boat was addressed. Mr. Quint stated that parking was addressed as part of the approved harbor district site plan. Chairperson Day opened the public hearing and called for comments. Ms. Keresa Richardson, 200 Falling Water, McKinney, Texas, stated that she is in favor of this item. Ms. Richardson stated that her property is located directly across (east) from the ship. She stated that she is very excited to have the view of the boat. Ms. Richardson stated that she has had conversations with other property owners that live along the lake and they are all in favor of this item. She stated that if a napkin or other debris shows up on her side of the lake, she will be happy to pick it up. Ms. Richardson stated that she feels that this is a unique opportunity for the City of McKinney to have such a great feature as the Galleon Dubrovnik. On a motion by Commission Member Ussery, seconded by Commission Member Tate, the Commission voted 6-1 to close the public hearing and recommend approval of the proposed specific use permit, with the special ordinance provisions listed in the staff report. Commission Member Staif opposed. Chairperson Day stated that the recommendation of the Planning and Zoning Commission will be forwarded to the City Council at the June 19, 2007, meeting.
